"Hier is je geld, en nu wegwezen!"

The Dallas Cowboys have agreed to pay a photographer $275,000 to settle a lawsuit over use of a copyright photograph featuring former star running back Emmitt Smith.

Under terms of the agreement, the team will stop using an image of Smith kneeling on the star in the middle of Texas Stadium in any promotion or advertising.

The settlement includes a clause barring Walter Smith of Impact Images from returning to Texas Stadium to take any more photographs, said his attorney, Jim Davis.

Walter Smith snapped the photo on Sept. 28, 2000. The photographer gave the team a digital file of the photo, which the team considered using on season tickets, Davis said in a statement. The team eventually chose another design but bought 250 copies of the photo for resale.

Smith discovered the copyright had been infringed when he saw the photo on team merchandise when he stopped by a Cowboys booth at the State Fair of Texas, according to the statement.
